Coinbase Wins Arbitration Bid in Crypto Customers’ Fee Spat (1)

Coinbase Inc. customers suing for allegedly hidden fees failed to convince a federal court that an arbitration agreement wasn’t enforceable due to an unconscionable class waiver.

Their primary argument citing a 2005 California Supreme Court decision was undercut by the Federal Arbitration Act, Judge Charles R. Breyer said. The US Supreme Court in 2011 found that the a rule set forth by Discover Bank v. Superior Court interfered with the federal act’s purposes, preempting the state court decision, the US District Court for the Northern District of California judge said Tuesday.
